TUESDAY, APRIL 30, 2002

A federal judge in Idaho issued a temporary restraining order on Monday to prevent the state from collection a retroactive tax on tribes.

U.S. District Judge Lynn Winmill threatened to side with the Coeur d'Alene Tribe last week. She followed up and said the tax should be halted pending a full review of the case.

The 25-cent-per-gallon tax was due to be collected starting today. The Legislature made it retroactive to 1996 in response to a court decision the state lost.
