Court strikes Mohawk gaming compact

FRIDAY, MAY 3, 2002

A New York appellate court on Thursday ruled the St. Regis / Akwesasne Mohawk Nation is operating its casino without a legal gaming compact.

The third appellate division in a unanimous ruling said the tribe can't operate Class III games. But the court did not order the casino to be shut down.

The plaintiffs, which include several anti-casino groups, said they plan to ask the Department of Interior to order the removal of the offending machines.

The legality of the state's expansion of gaming is an open question.
