The D.C. Circuit Court of Appeals heard arguments on Thursday in a lawsuit that seeks to block the Pokagon Band of Potawatomi Indians from opening a casino.

The tribe's federal recognition was restored by an act of Congress. The act requires that the federal government create an initial reservation for the tribe.

The tribe selected a 675-acre parcel in New Buffalo and plans to open a 144,000-square-foot casino on the land. A group called Taxpayers of Michigan Against Casinos is fighting the proposal but judges on the appeals court indicated skepticism, according to the Associated Press.
