Judge won't let Wyandotte Nation be sued by casino patron

The Wyandotte Nation can't be sued by a casino patron due to sovereign immunity, a federal judge ruled on Wednesday.

The patron sued the tribe after suffering a fall at the 7th Street Casino, a Class II facility in downtown Kansas City, Kansas. Judge Daniel D. Crabtree dismissed the case, ruling that the tribe has not waived its immunity.

"Absent an unequivocal waiver by the Wyandotte Nation or any contrary legislative intent, the court concludes that the doctrine of sovereign immunity bars plaintiff’s suit," Crabtree wrote in the 15-page decision.
