Mashantucket Tribe disputes NLRB jurisdiction

The National Labor Relations Board concluded its hearing on a labor union dispute at the casino owned by the Mashantucket Pequot Tribal Nation of Connecticut.

About 4,000 employees want to organize with the United Auto Workers union. The UAW asked the NLRB to schedule an election on the reservation.

But a lawyer for the tribe says the NLRB "lacks jurisdiction in this matter. Period," The Norwich Bulletin reported. The tribe won't commit to the union election, attorneys said.

Tribes aren't mentioned anywhere in the National Labor Relations Act. But the NLRB said it would apply the law on a case-by-case basis.

Factors include whether a tribal enterprise, such as a casino, employs non-Indians or affects non-Indians.
