State asserts eminent domain on behalf of tribe


The state of New York has begun eminent domain proceedings on behalf of the Seneca Nation in order to fulfill a land claim settlement.

The state promised the tribe a 52-acre as part of the deal. The tribe has purchased about half of the property in Niagara Falls.

The owners of homes and hotels on the land in question say they don't want to give up their properties. The U.S. Supreme Court, in a controversial decision, recently upheld the power of local governments to assert eminent domain for economic development purposes. The tribe will use the land as part of its off-reservation casino.
