Mescalero Apache Nation sues over insurance firm

The Mescalero Apache Nation of New Mexico has filed suit over an insurance company that it is accusing of fraud and breach of trust.

The tribe sued the state Public Regulation Commission for reinstating the corporate status of the Leavitt Group The firm is headed by Dane Leavitt, the brother of Bush administration official Mike Leavitt, whose family is in the insurance business.

The tribe wants PRC to revoke the Leavitt Group's status, a move that could help the tribe with another lawsuit that was filed directly against the firm. The tribe says the Leavitt Group sold fraudulent insurance coverage.

The Leavitt Group fired Kenneth Woodley, who was the managing co-owner, for misrepresentations made in connection with selling insurance to the Mescalero Apache Nation and other tribes in New Mexico.
