Navajo Nation appeals ruling on oil shipping tariffs

The Navajo Nation is appealing a decision by the Federal Energy Regulatory Commission over oil shipping tariffs.

The tribe says the new rates are discriminatory and would disadvantage oil producers on the reservation. The tariffs apply to oil shipped on a pipeline owned by the Western Refining Pipeline Co..

In a March 7 order, the FERC said the tribe lacked standing to challenge the rates because tribal producers do not ship on the pipeline. The decision went into effect on March 10.
