A federal judge won't dismiss charges against a man accused of murdering American Indian Movement activist Anna Mae Pictou Aquash.

Richard Marshall, a member of the Oglala Sioux Tribe of South Dakota, said federal prosecutors took too long to bring the case. Aquash was murdered in December 1975 on the Pine Ridge Reservation.

Marshall is due to go to trial on October 6. He is accused of supplying the gun that was used to kill Aquash.

A second defendant, John Graham, a Native man from Canada, was charged with Aquash's murder. The 8th Circuit Court of Appeals said he couldn't stand trial in federal court because he is not a member of a U.S.-recognized tribe.

Aquash was Mi'kmaq from Canada.
