Tax commission opposes tribe briefs in reservation case
The Oklahoma Tax Commission doesn't want the 10th Circuit Court of Appeals to accept briefs from tribes and tribal organizations in a case involving the Osage Nation.

The commission says the dispute over the status of the Osage Reservation only affects the Osage Nation. "The case does not implicate the interests of other tribes," the commission told the court in a brief.

Other tribes disagree. Four Oklahoma tribes, the Osage Nation Bar Association, the National Congress of American Indians and the Confederated Tribes of the Colville Reservation in Washington are asking a full panel of the 10th Circuit to rehear the case.

Congress created the reservation in 1872. The tribe says it continues to exist and says the commission can't collect state taxes from tribal members who live and work within reservation boundaries.

If the 10th Circuit declines to rehear the case, the tribe could petition the U.S. Supreme Court for review.
