A non-Indian man who was arrested for holding a protest at a U.S. military missile site in North Dakota wants to be tried by the Mandan, Hidatsa and Arikara Nation.

James Richard Sauder is charged with trespassing at the Minuteman III launch site. He is being prosecuted by the U.S. Attorney's Office but he says he should be prosecuted by the tribe because the site is on the Fort Berthold Reservation.

Sauder broke into the site on April 15. He was conducting a "prayer" when he was arrested and has linked his protest to a vast military cover-up and the September 11, 2001, terrorist attacks.

Sauder faces a sentence of six months in prison if convicted, The Minot Daily News reported.
