A federal judge extended a restraining order that prevents the state of New York from imposing a tobacco tax on two tribes.

The order was due to expire Friday. Judge Richard Arcara extended it to November 12.

The order affects the St. Regis Mohawk Tribe and the state-recognized Unkechaug Nation. Both tribes have asked for a preliminary injunction against the state.

Arcara rejected a preliminary injunction in a case brought by the Seneca Nation and the Cayuga Nation.
