Supreme Court limits disabilities act

TUESDAY, JUNE 11, 2002 The Supreme Court on Monday ruled that employers have the right to determine whether a job would endanger the health and welfare of an employee. The unanimous ruling allows a company to refuse work to someone deemed undesirable based on a medical condition or "disability." The case involved a worker who sued Chevron after being denied employment. The ruling was another defining the scope of the Americans with Disabilities Act (ADA) of 1990. Writing for the majority, Justice David H. Souter, said the Equal Employment Opportunity Commission was reasonable to assume employees could refuse jobs based on a threat to self and a "threat to others." Get the Story:
