An attorney representing an Indian business owner said a court ruling on taxation is unfair.

The 9th Circuit Court of Appeals yesterday said members of the Yakama Nation of Washington must pay federal road use and diesel fuel taxes. The court rejected an exemption under an 1855 treaty.

Timothy Weaver, attorney for tribal member Kip Ramsey, said the decision creates an impossible burden. "My client in 1885 had to know that the United States was going to charge them for diesel," Weaver told the Associated Press.
