The Absentee Shawnee Tribe of Oklahoma has dropped plans to open a casino on land that was being investigated by the National Indian Gaming Commission.

The 35 acres is held in trust for the tribe but is under the jurisdiction of the Citizen Potawatomi Nation, The Daily Oklahoman reports. The NIGC was going to determine whether the Shawnees had a right to open a casino on the land.

Under federal law, a tribe can game on land it exercises governmental authority over.
