Judge: Treaty doesn't apply to permit process

A judge in Virginia has rejected a treaty rights claim of the Mattaponi Tribe.

The tribe said 17th-century treaty prohibits construction of a massive reservoir . But the judge said the State Water Control Board doesn't have to consider the treaty when awarding water permits.

The judge is considering other arguments against the project.
