Donald Marshall Jr., the Mi'kmaq fisherman whose fight against the Canadian government led to an historic Supreme Court decision, is recovering from a double-lung transplant, CBC News reports.

Marshall was suffering from chronic obstructive pulmonary disease. He underwent an eight-hour operation.

In Marshall's case, the Supreme Court in 2000 upheld Mi'kmaq fishing rights off-reserve. Also, in 1983, he was cleared for being wrongly convicted of murder.
