Ban on elk transfer to tribe in place

A federal judge on Wednesday said she won't let a Montana couple transfer a herd of elk to the Crow Tribe because state law prohibits the move.

Just because the elk herd will end up on the reservation, where the state's livestock laws won't apply, doesn't mean the transfer can occur, said US District Judge Dorothy McCarter. The state's Department of Fish, Wildlife and Parks had opposed the transfer of the elk becuase it said the tribe planned on letting the animals roam free, threatening other species.
