Crow elk ruling may be challenged

The owner of an elk farm in Montana on Thursday said he is considering appealing a temporary court order barring him from giving some of his herd to the Crow Tribe.

A federal judge told Lew Wallace he couldn't continue giving some of his herd to the tribe because the state didn't authorize the transfer. Although state laws don't apply to the reservation, a judge said Wallace needed state approval to transport the animals, regardless of their destination.

The state opposes the gift because it fears the animals could harm livestock or the environment once allowed to roam free on the reservation.
