Couple challenges Crow elk ruling

MONDAY, JULY 9, 2001

A Montana couple has filed court papers with the Montana Supreme Court challenging a recent ruling which prevents them from transferring some of their elk herd to the Crow Tribe.

The couple says the state is unfairly intruding on tribal sovereignty by preventing the transfer. Enough though the state's environmental laws don't apply on tribal land, the state won't let the elk be moved from the couple's game reserve -- which is on state land -- because it fears the elk will hurt other livestock if allowed to roam free on the reservation.
