Democrats and environmentalists on Thursday criticized Environmental Protection Agency Administrator Christie Whitman for testimony she made regarding pollution litigation.

Whitman told the Senate Governmental Affairs Committee that the power industry probably won't want to negotiate to improve their facilities until a federal appeals court makes a ruling in a related case. She said a decision would affect whether companies want to work with her agency.

Her remarks, to some, appeared to be suggesting she would not defend the lawsuits the Clinton administration filed. But an industry representative said her view was just common sense.
