State wants Crow elk ruling

A Montana couple has asked the State Supreme Court to dismiss their appeal of an order that prevented the transfer of some elk to the Crow Tribe.

But the state still wants the court to rule on the dispute even though the Wallaces have gotten rid of most of their herd. The state contends transfers could take place in the future.

The couple was prevented from giving the elk to the tribe because they didn't have a state permit to transfer the animals. But the state was also worried that the elk would roam free on the reservation, where state laws don't apply.
