Indian inmate wins Mont. case

The Montana Supreme Court on Tuesday ruled that an American Indian inmate did not receive a fair parole hearing from the state's Board of Pardons.

The court said Donny Ray George's hearing was unfair because the Board's American Indian member did not participate in his review. Under state law, the board is to have at least one member who has knowledge of Indian issues.

Four of seven justices signed an order to enforce the law for all Indian inmates.

Montana has one of the higher per capita rates of Native incarceration in the country.
