Supreme Court urged to keep execution case

The lawyer of a North Carolina man whom advocates say is mentally retarded is urging the Supreme Court not to dismiss his case.

The Supreme Court had accepted Ernest McCarver's case in March. But North Carolina's Attorney General asked the Court to dismiss the case, because the state passed a law banning the execution of mentally retarded inmates.

McCarver's attorney says the case is still relevant and that he wouldn't benefit from the law anyway.
