State wants to reclaim Pequot documents

SEPTEMBER 21, 2000

The state of Connecticut is ready and prepared to reclaim any documents currently in the possession of the Mashantucket Pequot Tribal Nation, provided they can prove ownership.

Under the doctrine of replevin, the state can reclaim documents and records which have gone out of its possesion. The tribe has already agreed to return the documents if it can be shown they belong to the state.

A rare books dealer says governments using the doctrine to reclaim property is common nowadays. He adds that states sometimes throw out valuable documents themselves.
