State wants US out of Oneida lawsuit

Officials from New York state, including Governor George Pataki, asked the Department of Justice to stop supporting the Oneida Nation in a lawsuit against the state.

The government is bound by law to support or intervene on the behalf of tribes in certain cases. But Pataki and others called for the withdrawal of the goverment anyway and some local residents want Congress to write a law that would permanently protect property owners from eviction in land claims cases.

The Department of Justice responded by saying it was New York state's wrondgoing that brought about the Oneida case. A judge on Monday ruled that the state could be added to the tribe's lawsuit to settle its land claims case, but that local landowners could not.
