Affirmative action appeal dropped

Citing the changing nature of arguments by a white-owned Colorado firm, the Supreme Court on Tuesday unanimously dropped its appeal of a case challenging affirmative action federal contracting programs.

The Court in a per curiam order said Adarand Constructors was making new arguments that weren't previously presented. Therefore, the Justices returned the case to a lower court for a proper determination of of the issues.

The case has been in the court system for years. It had resulted in restrictions on race-based contracting programs at the Department of Transportation and a new decision at this time could have resulted in more.
