Peyote dispute heading to Utah court

FRIDAY, JANUARY 11, 2002

Utah's Supreme Court has agreed to hear a case challenging whether non-Indians can use peyote.

Two men claim they have a right to the hallucinogen as practitioners of the Native American Church. But under a federal exemption, only members of federally recognized tribes are allowed usage.

Neither man can document his Indian heritage, so each claims freedom of religion allows the use of the drug.
