Oneida Nation v New York State
Logo © Oneida Nation Over 15 years ago, the Oneida Nation won a landmark decision when it was determined their lands were seized illegally by New York state more than a hundred years ago. Finding a settlement to this never ending saga might take another hundred as talks between the tribe and the state have broken down yet again.

Case Law:
County of Oneida v. Oneida Indian Nation, 470 U.S. 226 (1985) - rules that the Oneida are entitled to compensation for illegal land tranfers. Why were these land transfers illegal? As agreements between a state and an Indian nation instead of the federal government, it violated the Trade and Intercourse Act of 1793 (Nonintercourse Act), 1 Stat. 329.
