The California Gambling Control Commission has denied an unrecognized group of Indians the right to money from the state's tribal gaming fund.

The group is not considered federally recognized, said the state, so they are not entitled to the funds. The group was part of the historic Capitan Grande Band of Diegueño Mission Indians but did not have a reservation established, unlike the Barona and Viejas bands.

If the group is acknowledged as a tribe, its reported 35 members could share up to $1.1 million a year from the fund. The fund is made up of money gaming tribes contribute so that non-gaming tribes can benefit.
