The manager of a casino owned by the Absentee Shawnee Tribe of Oklahoma faces an October 10 contempt hearing for operating certain games in violation of court orders.

U.S. District Judge Wayne Alley had ordered the tribe to shut down certain games at the casino because the National Indian Gaming Commission said they were Class III. Class III games cannot be operated in Oklahoma without a tribal-state compact.

Federal prosecutors claim manager Mickey Burke violated the court order by not shutting down the games. The tribe has appealed the NIGC's classification of the games.

New rules under consideration by the NIGC might result in the games being considered Class II.
