10th Circuit nominee facing scrutiny

Now that the Democrats are to take control o the Senate, liberal and civil rights groups hope the change will affect conideration of President Bush's judicial nominees, particularly Michael W. McConnell.

Bush has nominated McConnell, a University of Utah law professor, to the 10th Circuit. In this position, he would oversee cases affecting tribes in Colorado, Kansas, New Mexico, Oklahoma, Utah, and Wyoming.

McConnell has advocated for a greater role of religion in society and last year he won a Supreme Court case upholding the use of federal funds for religious schools. He is also anti-abortion.
