FRIDAY, OCTOBER 26, 2001

A status conference on the trust fund lawsuit will be held on Tuesday, October 30, the plaintiffs reported today.

U.S. District Judge Royce C. Lamberth will hold the conference at the U.S. courthouse in Washington, D.C. at 10 a.m. Lamberth had postponed a previously scheduled update due to September 11's terrorist attacks.

A number of outstanding issues have been put before Lamberth, including two recommendations for contempt for employee retaliation, a citation for sanctions for destroyed e-mails, a request to start the second phase of the trial, a proposal to order the Department of Interior to complete an historial accounting and a motion to strip the government of its trust fund duties and place 39 government officials, lawyers and management in contempt.

Lead plaintiff Elouise Cobell, a banker from the Blackfeet Nation of Montana, plans to attend.
