A judge in South Dakota on Wednesday refused to turn over two teens involved in a racially charged shootout to the adult criminal system.

The teens face aggravated assault charges for the November 1 incident involving members of the Crow Creek Sioux Tribe girls basketball team. One teen admitted shooting a gun at the girls.

The judge said the incident did not appear to be racially motivated. The tribe has called for federal civil rights charges to be brought against the pair.

Tribal chairwoman Roxanne Sazue and others from the tribe expressed outrage about the judge's decision.
