The Winnebago Tribe has instituted a new 3-cent tax on the sale of motor fuel at its gas stations on their Nebraska reservation.

Prior to the new tax, the tribe had two different taxing structures: one for Indians and one for non-Indians. The structure hardly brought in revenue for the tribe.

But under the new tax, the tribe stands to gain $200,000 to $300,000 a year. Federal law prevented the tribe from taxing non-Indians without proper authority but in accordance with a legal opinion issued by the state, the tribe instituted the new tax this month.

The state agrees the tax is perfectly legal because it meets various criteria laid out by federal policy.
