Santee casino decision appealed

The U.S. Attorney's office in Nebraska has appealed a federal judge's decision that favored the Santee Sioux Tribe's tiny casino operation.

U.S. District Judge Joseph Bataillon in December ruled that 60 of the tribe's recently installed gaming devices are Class II machines. Therefore, they can be operated without a gaming compact, he said.

Federal prosecutors believe otherwise.
