Court postpones hearing on Yazzie/Martinez lawsuit 

Plaintiffs and defendants jointly asked for delay due to COVID-19 pandemic

SANTA FE—The First Judicial District Court has postponed the hearing, set for this Friday, to hold the state in compliance with the court order on the Yazzie/Martinez v. State of New Mexico lawsuit. The hearing will take place sometime in June of 2020. 

Plaintiffs and defendants cited public health directives concerning the COVID-19 virus as the reason for their joint request for a postponement.         

The court also agreed to the parties’ request that responses to the state’s motion to dismiss the lawsuit be due on May 1, 2020. The state’s motion and the plaintiffs’ responses will all be heard at the rescheduled hearing in June.

The parties were informed by a court clerk for the First Judicial District Court yesterday that the court granted their requests.
