Judge dismisses lawsuits against Enterprise Rancheria casino

Monday, September 23, 2013

A judge in California dismissed two lawsuits that were aimed at blocking an off-reservation casino for the Enterprise Rancheria.

The United Auburn Indian Community filed one suit and another was filed by casino opponents. Both challenged whether Gov. Jerry Brown (D) had the authority to concur with a two-part determination for the casino.

The judge, however, said Brown was not bound by the California Environmental Quality Act. The judge also said the decision to take the land into trust for the casino was made by the federal, not the state, government.

Turtle Talk has posted the decisions in United Auburn Indian Community v. Brown and Citizens for a Better Way v Brown.

The casino still faces litigation in federal court. The tribe's Class III gaming compact has stalled in the Legislature due to opposition from tribes with existing casinos.
