State appeals Catawba Nation gaming victory

The state of South Carolina is appealing the Catawba Nation's recent gaming victory.

A state judge ruled that the tribe has a right to operate video poker even though it has been outlawed by the state. The judge cited the tribe's 1993 Congressional settlement act [Settlement act proves helpful for Catawba Nation].

The state contends the act bars the tribe from offering gaming that is not legal in the state. A motion to appeal was filed on Tuesday.

The tribe says it will drop plans to offer video poker if the state agrees to an expansion of a bingo hall off the reservation. The bingo hall falls under state law.
