Suit over land determination for Seneca casino

Opponents of a casino in downtown Buffalo, New York, are questioning the Indian land determination made for the Seneca Nation.

Opponents say the Interior Department made a mistake by considering the land eligible for gaming under Section 20 of the Indian Gaming Regulatory Act. Interior says the tribe qualified for the land claim exception.

Attorneys for the federal government and for the tribe contend the determination was correct. The Seneca Nation is the only tribe to utilize the land claim exception in the history of IGRA.
