NIGC fines Kaw Nation over late MICS-related report


The National Indian Gaming Commission issued a notice of violation to the Kaw Nation of Oklahoma for submitting a late report related to the minimum internal control standards (MICS).

The Agreed Upon Procedures (AUP) report is supposed to be submitted within 180 days of the end of a fiscal year. But the NIGC says the it didn't receive the Kaw Nation's report for several months.

"The current leadership of the Kaw Nation has been responsive to NIGC’s concerns in this regard, but in view of the Tribe’s delinquency of more that 180 days, an NOV at this time was merited," said NIGC Chairman Phil Hogen.

According to the NIGC, an AUP report verifies that a gaming operation is in compliance with the MICS. But a federal appeals court recently ruled that the NIGC can't enforce the MICS on Class III operations.

The Kaw Nation operates the South Wind Casino in Newkirk.
