Catawba Nation takes gaming to Supreme Court

The Catawba Nation of South Carolina is asking the U.S. Supreme Court to review its Indian gaming case.

The tribe wants to operate video poker on the reservation. But the state Supreme Court said the tribe can't offer the game because it was outlawed by the state constitution.

The tribe falls under a special act of Congress that allows some forms of gaming. At the time the law was passed, video power was authorized in the state.

The law, however, bars the tribe from going under the Indian Gaming Regulatory Act.

The tribe filed its petition with the Supreme Court on July 16. The state's response is due August 17 [Docket Sheet: No. 07-69].
