A judge in California said a voter referendum on the gaming compact for the Agua Caliente Band of Cahuilla Indians can go forward.

The tribe sued in state court to stop the February 5, 2008, election. The tribe said its gaming compact can't be put a public vote but a Sacramento County Superior Court judge disagreed.

The Agua Caliente Band, the Pechanga Band of Luiseno Indians, the Morongo Band of Mission Indians and the Sycuan Band of the Kumeyaay Nation signed compacts to add more slot machines to their casinos. Opponents say the deals are unfair to unions and other tribes.
