Oklahoma court determines games are Class III

An Oklahoma court has determined that two casino machines manufactured by Multimedia Games (MGAM) are Class III machines.

Judge Noma Gurich in Oklahoma County said her determinations on MegaNanza and Reel Time Bingo are not binding on any tribe. She nevertheless asserted jurisdiction in a lawsuit against MGAM for violating state anti-trust and deceptive trade laws [PDF: Court Order].

Diamond Games says MGAM marketed the machines to Oklahoma tribes as Class II. But Diamond, a much smaller company, says MGAM knew the machines were Class III.

At the time the lawsuit was filed, Oklahoma had just legalized Class III games. Tribes that signed the compact are required to share a percentage of their Class III revenues with the state.

The case is Diamond Game Enterprises Inc v. Multimedia Games Inc., No. CJ-2004-9366.
