Last December, the Interior Department issued a finding of no significant impact for the off-reservation casino sought by the St. Regis Mohawk Tribe of New York.
It's now up to New York Gov. Eliot Spitzer (D) to concur or reject the casino. But the process won't be over if he approves -- Interior Secretary Dirk Kempthorne still has to decide whether to take the land into trust for the tribe.
As governor of Idaho, Kempthorne opposed off-reservation gaming. The department is now trying to address his concerns with the practice.
In a letter to the tribe, Interior urged the consideration of on-reservation casino sites. The department said the issuance of the FONSI did not mean the tribe's land-into-trust application would be approved.
