The Fort Sill Apache Tribe of Oklahoma plans to open a restaurant and smokeshop at its gaming site in New Mexico.

The tribe has 30 acres in trust off a major interstate near Deming. The site is the subject of a court dispute with the National Indian Gaming Commission, which has raised questions about its legality.

Pending resolution of the gaming issue, the tribe will open the restaurant today. Gov. Bill Richardson (D) doesn't have a problem with that, a spokesperson said, but opposes a casino.
