DOJ argues NEPA not required for Quapaw casino

The Department of Justice says the Quapaw Tribe of Oklahoma didn't have to comply with the National Environmental Policy Act before building a casino.

The Joplin Globe reports on a motion to dismiss in a lawsuit that challenges the $301 million Downstream Casino Resort. The facility, located in parts of Oklahoma, Kansas and Missouri, is scheduled to open on July 5.

Cherokee County in Kansas sued the Interior Department to block the casino, alleging violations of NEPA. But DOJ says compliance was not required because the gaming site was transferred to the tribe under the Indian Land Consolidation Act.

The gaming portion of the casino is located on a 40-acre Indian allotment that the tribe purchased.
