Fort Sill Apache Tribe removes gaming machines

The Fort Sill Apache Tribe of Oklahoma is removing about 50 electronic gaming machines from its proposed casino in New Mexico.

The tribe leased the Class II machines from the Citizen Potawatomi Nation. But with the casino's future in doubt, the tribe is sending the devices back to Oklahoma.

The tribe has 30 acres in trust in southern New Mexico. An opinion from the National Indian Gaming Commission says the land can't be used for gaming since it was taken into trust after 1988 and doesn't satisfy any of the exceptions in Section 20 of the Indian Gaming Regulatory Act
