Opponents of the Seneca Nation want the National Indian Gaming
Commission held in contempt of court for failing to shut down the tribe's off-reservation casino in Buffalo, New York.
Citizens Against Casino Gambling sued the NIGC over the legal status of the Buffalo Creek Casino. A judge ruled that the site was not eligible for gaming under the Indian
Gaming Regulatory Act since it was taken into trust after 1988 and didn't satisfy any of the exceptions in Section 20 of the law.
The NIGC issued a notice of violation to the tribe
in September but the tribe's temporary facility still offers gaming.
“So now, eight weeks later, when nothing has still been done, the time has come to go back and say enough is enough,” Cornelius D. Murray, an attorney for casino opponents, told The Buffalo News.
The agency has until Monday to challenge the judge's ruling on the casino.
