Without debate or a hearing in the 111th Congress, the Senate on Thursday passed a bill to limit the Lytton Band of Pomo Indians from expanding its off-reservation casino in San Pablo, California.
The tribe acquired the San
Pablo Lytton Casino site through an act of Congress. The law backdated
the acquisition in order to avoid review under Section 20 of the Indian
Gaming Regulatory Act.
S.338 requires the tribe to go through the Section 20 process if it ever intends to expand the facility or offer Class III games. The bill, however, does not bar the tribe from claiming a Section 20 exception.
S.338 passed the Senate by unanimous consent. The Senate Indian Affairs Committee did not hold a hearing on the bill but discharged it by unanimous consent as well.
A comparable bill hasn't been introduced in the House.
